Terms of Service

These Terms of Service ("Terms") govern your use of FluxType, an AI-powered voice dictation application for Windows, and the associated website at fluxtype.app (collectively, the "Service"). By downloading, installing, or using FluxType, you agree to be bound by these Terms.

1. Software License

We grant you a limited, non-exclusive, non-transferable, revocable license to use FluxType for personal or professional purposes in accordance with these Terms. This license does not include the right to sublicense, distribute, or commercially redistribute the software.

2. Service Tiers

Free tier: Unlimited English transcription using on-device AI models. No account is required. Available indefinitely at no cost.

Pro tier: Includes support for 50+ languages, real-time streaming transcription, and access to cloud-based transcription providers. Subscription is billed monthly ($5.99/mo) or annually ($3.99/mo, billed as a single annual payment). Subscriptions are managed through fluxtype.app, and payments are processed by Polar.

3. User Responsibilities

By using FluxType, you agree that you will not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the software.
• Redistribute, resell, lease, or sublicense the software to any third party.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the software.
• Use the software for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to circumvent any subscription, licensing, or usage restrictions.

4. Third-Party Services

FluxType integrates with third-party services, including OpenAI and Deepgram, for optional cloud-based transcription. Your use of these services is at your own discretion and is subject to their respective terms of service and privacy policies. FluxType is not responsible for the availability, accuracy, or conduct of any third-party service.

5. Intellectual Property

FluxType and all associated trademarks, logos, and content are the property of FluxType and its licensors. These Terms do not grant you any right, title, or interest in the Service beyond the limited license described in Section 1.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FluxType and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service.
• Any unauthorized access to or alteration of your data or transmissions.
• Any third-party conduct or content related to the Service.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the software will immediately cease.

You may terminate your account at any time by cancelling your subscription through fluxtype.app. Free-tier users may simply uninstall the software.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FluxType operates, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify Pro users by email and update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
